PRIVACY STATEMENT / TERMS AND CONDITIONS

It is necessary to the success of the the 360 degree safe Self Review Tool that a school that uses the tool can do so privately, to avoid schools feeling unable to use the provision or providing inaccurate information. Were this to happen the benchmarking would be skewed unacceptably towards only those schools confident or seemingly confident that the outcomes would be more or less wholly positive. This privacy statement / terms and conditions is intended to enable the the 360 degree safe Self Review Tool to be as fully effective as possible by enabling all schools to participate privately and to be sure that all other schools will participate on the same basis and gain the maximum benefit from the benchmarking provided.

In this registration and privacy statement / terms and conditions “School” means the head teacher and other governors of your School acting as your governing body and “SWGfL” means the South West Grid for Learning Trust a charity registered with the Charity Commission number 1120354 established as a company limited by guarantee registered at Companies House number 5589479. You confirm that you have authority to act on behalf of your School and in that capacity you agree on behalf of your School to comply with this privacy statement / terms and conditions which forms a binding contract between the School and SWGfL in respect of its subject matter.

Any contact information collected about you and data collected about your School is collected and retained on the understanding that SWGfL will only hold and process your details and your School’s data for the purposes stated at the time of registration, or at such time that you amend your details or your School’s data.

The the 360 degree safe Self Review Tool is offered by SWGfL to your School as an on-line tool which is intended to enable your School to
• review e-safety policies and procedures
• identify strengths and weaknesses
• benchmark e-safety policy and provision against a range of other schools
• identify how the School might move practice from one level to another (a
continuum from basic to innovative and aspirational practice).

Benchmarking is a process in which one school’s position is compared against the averaged performance of a number of schools. In order to provide a useful and valid benchmarking tool, SWGfL will store data held on your School and others and generate averaged data from a number of schools including your School.

This averaged data will then be made available in an anonymous and aggregated format to your School and other schools through the benchmarking part of the the 360 degree safe Self Review Tool. SWGfL will also use the data in an anonymous and aggregated format to report on the state of e-safety provision in schools and to identify, in general terms, the needs of schools for e-safety services and training. You agree on behalf of your School that your School’s data used in the the 360 degree safe Self Review Tool is correct and complete and does not mislead. You and the School understand that the benchmarking provided by the the 360 degree safe Self Review Tool is only of value if all the underlying data is accurate.

Personal data submitted by schools will only be held while the school’s 360 degree safe Self Review Tool is active. For these purposes the personal data will be deleted if the SRT is inactive for a period of 12 months. After this time, the school can make the SRT active again by request to SWGfL and re-submission of personal data.

As a responsible Internet Services Provider, SWGfL will record details of IP addresses in order to trace any instances of abuse and report to schools any instances of unsuitable use of their on-line tool. This information will not be divulged to any other organisation, unless it is required by the police in connection with any activity that would be classed as illegal.

SWGfL will not disclose specific data from your School either to other individual schools or to other organisations without the express prior permission of the School or schools unless, exceptionally, SWGfL is required to make a disclosure by a specific externally imposed obligation valid under law.

Your School (or any other school) can allow other individuals or organisations access to the data relating to your School (or that other school) by granting them specific log-ins to their 360 degree safe Self Review Tool. A log-in granted by your School does not entitle anyone to access other schools’ 360 degree safe Self Review Tool and visa versa.

Your School is responsible for and agrees to ensure that any persons or organisations to whom or which it allows access to its 360 degree safe Self Review Tool agree to and shall act in accordance with this privacy statement / terms and conditions.

Your School, but not any other person (including anyone given a log-in granted by your School) may, if it wishes to do so, publish information about your School’s 360 degree safe Self Review Tool outcomes. It can not however publish the actual (and detailed) 360 degree safe Self Review Tool itself, as a matter of contract, in order to ensure appropriate commercial confidentiality in the interests of SWGfL.

You agree on behalf of your School that your School will meet any liabilities incurred by SWGfL caused by any person given a log-in by your School or by publication of information concerning its 360 degree safe Self Review Tool outcomes otherwise than in accordance with the privacy statement / terms and conditions.

Copyright in this 360 degree safe Self Review Tool and its underlying database and relevant software is owned by SWGfL. Your School and other educational institutions each are permitted free use of the 360 degree safe Self Review Tool for the purposes of their own self review in accordance with this privacy statement / terms and conditions. Any person or organisation wishing to use the document for other purposes, including commercial gain, should seek prior written consent from SWGfL and, if permission is given, will be expected to acknowledge SWGfL’s ownership and agree terms for use which may include payment.

Every reasonable effort has been made to ensure that the information included in this document is accurate and the 360 degree safe Self Review Tool and benchmarking are competent, as at the date of publication in September 2009 and when accessed respectively. SWGfL does not, however guarantee accuracy or competence, nor does it have any liability in respect of use of the 360 degree safe Self Review Tool by you or your School save to the least extent required by law.

No third party has any rights in respect of this privacy statement/terms and conditions under the Contracts (Rights of Third Parties) Act 1999. The School and SWGfL each reserves the right to take regulatory or civil court action or initiate proceedings without prior notice under, without limitation, the Computer Misuse Act 1990 or the Fraud Act 2006 in respect of unauthorised access to your data or School data including without limitation any 360 degree safe Self Review Tool completed by the School and any School benchmarking.
